So, today (28th May 2024), Episode 3 of the blockbuster movie “The Struggle for the Soul of Kano Emirate” premiered – in Kano and Abuja.
The movie features two political gladiators – Current Governor, Abba Yusuf and his the Former Gov, Umar Ganduje.
But before we delve deeper, let’s establish the background to the story….
Recall, on the 23rd, Gov Abba Yusuf instructed his loyalists at the Kano state House of Assembly to nullify the law that Ganduje used to remove Emir Sanusi and divide his Emirate into 5, in 2020. Ganduje replaced Emir Sanusi ll with Emir Ado Bayero.
The House of Assembly members (abi puppets) did as instructed. They passed a new law that removed Emir Bayero, reinstated Emir Sanusi, and shut down the other 4 Emirates.
While his dethronement was going on, Emir Bayero was in Ogun state for an official visit – more like the the same drama that happened in July, 1975 when Murtala Muhammed overthrew Gowon while he was attending OAU summit in Kampala.
But from Ogun state, Emir Ado Bayero was actively playing the game. With Ganduje’s influence, he quickly approached the Federal High Court in Kano. And they “arranged” one judgement that ordered Gov Abba Yusuf and his govt not to enforce the new Emirate Council Law.
Of course, as expected, Gov Abba Yusuf got the judgement and thrashed it to the bin – where he thinks it belongs.
So, it’s not surprising that the next day, 24th May, the Governor rushed to sign the new law and organized a swearing-in ceremony for Sanusi. There he gave him a “Letter of Appointment.”
Seeing that their attempt to stop Gov Abba Yusuf, through the court, failed, Ganduje and Emir Bayero arranged some political jobbers to stage a protest at both the National Assembly and Aso Villa, in Abuja. The group called itself “Northern Nigeria Peace and Development Foundation,” headed by one Abdullahi Saleh. This was while the swearing-in ceremony for Emir Sanusi was ongoing in Kano.
The National Assembly members seem not interested in getting involved. Tinubu, too, doesn’t want to get fully involved – he definitely needs both factions for 2027.
Swearing-in ceremony is done and dusted, Sanusi quickly moved into the palace, Gidan Rumfa at Kofar Kudu while Emir Ado Bayero was still in Ogun state. On Saturday, he ended his visit and returned to Kano. But to avoid “royal embarrassment,” he headed to a mini palace in Nassarawa Local Govt, Kano.
But Gov Abba Yusuf wasn’t satisfied. He went ahead to order the arrest of Emir Bayero. But the Police refused to arrest him. They said they’re obeying the court order by the Federal High Court – but we all know it’s pure “lamba.” They’re simply following “order from above.”
So, the struggle continued. Ganduje isn’t backing down. Gov Abba Yusuf, backed by his godfather – Kwankwaso is equally ready to f!ght to finish.
Fast forward to the event of today – Episode 3 in the drama series…
Seeing that the previous court Order by the Federal High Court that ordered him to suspend the new law that removed Emir Ado Bayero is having weight, as the Police refused to obey him and arrest Emir Bayero, Gov Abba Yusuf went to Kano High Court, earlier today to get his own court order. The Court was presided by one Justice Amina Adamu Aliyu.
Now, if you see the judgement, from the first line, you already know that this one was an “arrangee” judgement.
Part of the court order read, “that an order of interim injunction is hereby granted restraining (Emir Ado Bayero and Co) from further harassing, intimidating.inviting, arresting and or invading the personal or official residence (Emir Sanusi)” – which is the Gidan Rumfa Palace.
Just before Gov Abba Yusuf and Emir Sanusi could jubilate – together with their political boys – Ganduje and Emir Bayero ran to Abuja Federal High Court to “cook” their own judgement.
In just about few hours, the order was “cooked” and “served” hot. One Justice S. A. Amobeda, delivered the “hot breakfast.” The order is almost exactly the same with that of Kano high court.
It read, in part, “an order of interim injunction restraining the (Emir Sanusi and Gov Abba Yusuf) from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, raiding, tempering with or visiting the Emir Bayero in order to arrest or infringe on his right…”
Now, the entire state and Emirate is soaked in suspense – the people of Kano, and indeed, Nigerians are keenly watching the movie, with all eyes on the dramatic moves of the gladiators. What’s certain is that the “struggle for the soul of Kano Emirate” is in deadlock as of now.
But beyond the political gladiators, the three arms of govt are at loggerhead. The Kano Legislature made a law, the executive governor signed it, and about to implement it, then the justiciary proceeded to give an order to suspend the law.
The question is, should the court order override a law made by the legislature. Does the court have the jurisdiction to order the law to be suspended?
